Terms and Conditions
These Terms of Service ("Terms") govern your access to and use of the mobile application, website, and related services provided by Tuned ("Tuned," "we," "us," or "our") (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the consent of a parent or legal guardian. By using the Services, you represent that you meet these requirements.
2. Accounts
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
3. Use of the Services
You agree not to: (a) use the Services for any unlawful purpose; (b) interfere with or disrupt the Services; (c) attempt to gain unauthorized access to any systems or data; (d) copy, modify, or distribute any part of the Services without our permission; (e) use automated means to access the Services without our consent; or (f) impersonate any person or misrepresent your affiliation with any person or entity.
4. Purchases and Payments
Certain features of the Services may allow you to make purchases. All fees are stated at the time of purchase and, unless otherwise stated or required by law, are non-refundable. Payments are processed by third-party payment processors, and your use of those services may be subject to their terms.
Text Messaging
TUNED sends one-time verification codes by text message when you register or verify your phone number in the app. Message frequency is one message per verification request. Message and data rates may apply. Reply STOP to opt out, or HELP for help. Carriers are not liable for delayed or undelivered messages. For help, contact support@tuned.tickets or +1 310-595-1983.
5. Intellectual Property
The Services, including all content, features, software, and trademarks, are owned by Tuned or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.
6. Third-Party Services
The Services may contain links to or integrations with third-party websites and services. We are not responsible for the content or practices of any third party, and your use of third-party services is at your own risk.
7. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Services at any time. Sections that by their nature should survive termination will survive.
8. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. IN NO EVENT WILL OUR AGGREGATE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Tuned and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
11. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.
12. Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
